Alarm Terms and Signature

AAA Electronics Alarm Monitoring Terms

Company: AAA Electronics ("we," "us," "our"). Telephone: (818) 233-0202. Email: info@aaa-electronics.com. Alarm Company Operator license: ACO 7741.

Equipment, signals monitored, plan selected, price and payment dates are entered in the New Customer form and are part of this agreement.

1. Activation

We activate monitoring after you accept these terms, the first payment and the one time activation fee are received, and test signals from your system are received and verified by the monitoring center. Submitting the form, installing equipment or paying does not by itself start monitoring. We will confirm activation to you.

Only the devices and signals on your installed system and selected plan are monitored. We can't guarantee detection, signal delivery, or police or fire response. Call 911 in an emergency.

Alarm certificate. After the system is activated, we provide an alarm certificate for the Customer's insurance company.

2. Payment plans and fees

Your monitoring is billed on an annual plan by default. On request you can choose monthly, quarterly, semi-annual or annual billing. Prices are tiered by plan: monthly billing has the highest total cost and annual billing has the lowest. The price for your plan is shown on your form before you accept.

One time activation fee: $30. It is charged once and is nonrefundable.

If you pay by credit card, a card processing fee is added to the amount shown. There is no contract and there is no cancellation fee. You own the equipment you purchase.

Extra charges may apply for activity reports, timer tests, open and close reports and text messages. Standard text message rates from your carrier also apply.

3. Cancellation and refunds

To cancel, send us a written request (email to info@aaa-electronics.com is fine) at least 7 days before your next payment due date. Service ends at the close of the period you have already paid for.

If you are on the annual plan and cancel, we refund the unused full months of your prepaid year, counted from the effective cancellation date. Partial months are not refunded. Monthly, quarterly and semi-annual plans end at the close of the paid period, with no refund for the current period. The activation fee is not refundable. Completed work and separately approved charges remain payable.

Any cancellation or refund right that California law gives you applies even if it is more generous than this section.

4. Nonpayment and suspension

If a payment is overdue we may suspend monitoring after we notify you of the amount due, the planned suspension date and how to avoid it. We will tell you when suspension happens. Do not rely on a suspended system for monitored protection. Suspension does not cancel what you already owe for service provided.

5. We are not an insurer

We are not an insurer. Our charges pay for the monitoring services described here and are not insurance premiums. We do not insure your property or safety, and we do not pay your insurance deductible. Please maintain your own property and liability insurance. We do not guarantee that the alarm system or monitoring will prevent intrusion, fire, injury or loss. Alarm equipment and monitoring can reduce risk but cannot prevent every loss.

6. Equipment condition and excessive signals

Keep your system working and arrange repairs promptly. Repairs are not part of the monitoring charge unless the form says so. If your system is defective, is misused, or sends more than five unnecessary signals in 30 days, we may require a fix. If it is not fixed after notice and a reasonable chance to correct it, we may suspend or terminate the affected service.

7. Risk allocation

Monitoring fees are based on the value of the service, not the value of your property or the size of a possible loss. Losses and response times are hard to predict, and so is the share of a loss caused by an equipment or monitoring failure. The parties agree to the limit in Section 12, subject to the exceptions stated there.

8. Communication path: cellular plus internet backup

Your system reports alarm signals over a cellular network. When home internet or WiFi is available, we always connect it as a backup path for dual path communication. The system works on cellular alone, so home internet is not required. If cellular is down and internet is available, signals can go over the internet, and the reverse. Signals can still be delayed or lost because of weak coverage, outages, power or battery failure, equipment damage, carrier changes or an interruption at Alarm.com or the monitoring center. We do not guarantee continuous service or that every signal gets through. Please tell us right away about any communication trouble.

9. How the monitoring center handles signals

Burglar alarms: when the monitoring center receives a burglar signal, it verifies with the site, then contacts the first responsible party on your list, and dispatches police if necessary. A valid passcode cancels dispatch. A wrong or missing passcode means dispatch. Dispatch follows the monitoring center procedures, which may be updated from time to time.

Trouble signals: signals such as low battery and AC power loss are not handled immediately. They are held, and may be disregarded if the condition is restored. Please do not count on an immediate response to a trouble signal.

Extra charges: charges may apply for reports, timer tests, open and close reports and text messages, as described in Section 2.

10. Fire and life safety devices

Fire, smoke, carbon monoxide, panic and other life safety signals are monitored only if your form lists them. Install, power, use and test your devices as the manufacturer says and as codes require. Keep local alarms and detectors working even if monitoring is unavailable. A power loss, dead battery, failed device or loss of the communication path can stop reporting. Not every local detector is monitored. Fire accounts at commercial locations follow the central station rules and the fire marshal requirements.

11. Events outside our control

To the extent the law allows, we are not responsible for delays or interruptions caused by things outside our reasonable control, such as disasters, civil disorder, utility outages, carrier outages and third party network failures. We will tell you about a known major interruption when we reasonably can. This section does not excuse anything the law does not allow us to excuse.

12. Limit of liability

TO THE EXTENT PERMITTED BY CALIFORNIA LAW, OUR TOTAL LIABILITY, AND THE TOTAL LIABILITY OF OUR MONITORING PROVIDERS AND AGENTS COVERED BY THIS AGREEMENT, FOR LOSS CAUSED BY ORDINARY NEGLIGENCE, BREACH OF THIS AGREEMENT, OR FAILURE OF THE MONITORING SERVICES, SHALL NOT EXCEED $500.00 IN TOTAL. This limit is intended as contractual protection and an agreed split of risk. The insurance and no-guarantee terms in Section 5 also apply. It is not insurance, not a guarantee of payment and not a penalty.

THIS LIMIT DOES NOT APPLY TO FRAUD, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, OR ANY LIABILITY OR CONSUMER RIGHT THAT CALIFORNIA LAW DOES NOT ALLOW TO BE LIMITED. It does not reduce a refund or a legal cancellation right. Signing does not make an unlawful limit enforceable.

Who is protected. For this section, the protected parties are AAA Electronics, its monitoring center (including Becklar), Alarm.com, and the agents, employees, subcontractors, suppliers and affiliates involved in providing your equipment or monitoring services. The $500 limit is a single combined total for all protected parties and all covered claims under this agreement, not $500 for each party or incident. These parties may rely on this section.

Damages and remedy. Subject to the exceptions above, and only to the extent California law allows, the protected parties are not liable for indirect, incidental, consequential, special or punitive damages, including lost profits, business interruption or loss of use, arising from a covered equipment or monitoring failure. For covered claims based on ordinary negligence, breach of this agreement or failure of monitoring services, recovery within the $500 combined limit is your sole and exclusive damages remedy, regardless of the legal theory used. This does not remove your warranty, refund, cancellation or other rights that cannot lawfully be limited.

Insurance recovery and subrogation. Look first to your own insurance for an insured loss. To the extent your policy and California law permit, you waive your rights to recover an insured loss from the protected parties for claims covered by this section, including recovery rights that an insurer obtains by paying your claim (subrogation). Ask your insurer whether a policy endorsement is needed. This agreement does not bind an insurer that has not agreed to a waiver, and the exceptions above remain in effect.

Third-party claims. To the extent California law allows, you will reimburse the protected parties for reasonable losses and costs from a third-party claim caused by your intentional misconduct or negligent misuse of the system. This does not require you to pay for a protected party's own negligence, fraud, willful misconduct, gross negligence or violation of law, and does not waive any nonwaivable right.

Notice of a claim. Please notify us in writing promptly after learning of a loss or service failure, describe what happened, and preserve available system records so we can investigate. This request does not shorten any legal claim deadline or make late notice an automatic waiver of your rights.

13. California licensing notice

Alarm company operators are licensed and regulated by the Bureau of Security and Investigative Services, Department of Consumer Affairs. Questions about an alarm company operator may be sent to the Bureau of Security and Investigative Services, 2420 Del Paso Road, Suite 270, Sacramento, CA 95834. Telephone (916) 322-4000 or (800) 952-5210. Website: https://www.bsis.ca.gov/

14. Warranty and repairs

Equipment we install carries the manufacturer warranty for 12 months from the install date. We do not charge for a service call during the warranty period. After the 12 month warranty period, our standard service call charge applies. Damage from misuse, tampering, construction, vandalism, theft or similar causes is not covered. You are responsible for batteries, key fobs, keypads, cameras and similar items unless a warranty or written plan says otherwise. Nothing here removes any warranty right you have.

15. Your duties

Test your system at least monthly and after any power, equipment or communication change, following the manufacturer instructions. Call us or the monitoring center first so a test does not cause a dispatch. Tell us promptly about failed tests and communication trouble. Keep your contacts, passcodes, authorized users and emergency call list current, and keep your account access private. If we install your system we will instruct you in how to use it when we finish. For an existing system we will explain how activation and testing work.

16. Permits and false alarms

Your city may require an alarm permit or registration and may limit response without one or after repeated false alarms. You are responsible for your permits and for permit and false alarm charges from the city, unless the law puts the responsibility on us. We do not guarantee police, fire or medical response or response time.

Pets are a common cause of false alarms. If you have pets, we can install pet immune motion sensors rated for pets up to 55 pounds. Pet immune sensors reduce false alarm risk but do not guarantee against false alarms.

17. Ownership and your information

Our yard signs and decals remain ours and may be used only while service is active. Equipment you purchased is yours. You allow us, Alarm.com and the monitoring center to use your premises, contact, account and alarm signal information as needed to provide and support your service. We do not use it for unrelated marketing. Alarm.com and other apps have their own terms, which will be made available before you enroll.

18. Price changes

Your monitoring price includes the cost of the Alarm.com service for your package. If that provider cost changes, we may adjust your price once per year at your next annual anniversary. We give written notice at least 30 days before, stating the new price, the date and how to cancel. If we do not give that notice in time, the new price does not take effect that year. You may cancel before the new price starts without a cancellation fee. Any other change needs your written agreement.

19. Law, changes and acceptance

California law governs these terms, subject to mandatory law. If any part is unenforceable, the rest stays in effect. Nothing here waives your legal rights. You may not transfer this agreement to another person or address without our written consent. We may use qualified subcontractors and may assign the agreement only as the law allows and without reducing your cancellation or refund rights. The form, these terms, your billing consent and any written addendum we identify are the whole agreement. We will give you a copy you can keep.
